Credit Authorization & Disclosure

This Credit Authorization and Disclosure ("Authorization") is a legally binding agreement between you ("Applicant," "you," or "your") and Naos Finances LLC ("Company," "we," "us," or "our") governing your authorization for us and our lending partners to obtain, use, and share your credit information in connection with the Cash Advance Naos - Get Loans loan matching service and related applications (collectively, the "Service"). By submitting a loan application or otherwise using our Service, you acknowledge that you have read, understood, and agree to this Authorization. This document is provided in compliance with the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq., the Equal Credit Opportunity Act (ECOA), and applicable state and federal laws.

1. Authorization to Obtain Credit Reports and Consumer Reports

You hereby authorize Naos Finances LLC, our affiliates, and our network of third-party lenders and lending partners (collectively, "Authorized Parties") to obtain and use your credit report, credit score, and other consumer report information from one or more consumer reporting agencies (also known as credit bureaus), including but not limited to:

  • Equifax
  • Experian
  • TransUnion
  • Other consumer reporting agencies that may provide credit, employment, tenant, or other background information

This authorization applies to:

  • Initial credit checks performed when you submit a loan application through our Service
  • Subsequent credit checks by lenders when you are matched with loan offers or when you accept a loan offer
  • Periodic credit checks by lenders in connection with your loan account or account servicing
  • Identity verification and fraud prevention purposes
  • Pre-approval or pre-qualification inquiries (where applicable)

2. Types of Credit Inquiries

You understand that credit inquiries may be classified as:

2.1 Soft Inquiries (Soft Pulls)

Soft inquiries typically do not affect your credit score. They may occur when:

  • We or our partners perform preliminary eligibility checks or pre-qualification
  • You check your own credit
  • Lenders perform marketing or promotional checks

Soft inquiries may appear on your credit report but are not visible to other lenders and may not impact your credit score.

2.2 Hard Inquiries (Hard Pulls)

Hard inquiries may affect your credit score and typically occur when:

  • You submit a formal loan application
  • A lender makes a credit decision based on your application
  • You accept a loan offer and the lender proceeds with funding

Hard inquiries may remain on your credit report for up to two (2) years and may be visible to other lenders. Multiple hard inquiries within a short period may have a cumulative effect on your credit score. You authorize both soft and hard inquiries as described in this document.

3. Authorization to Share Information

You authorize us to share the information you provide in your application, as well as any credit report, credit score, or consumer report information we obtain, with:

  • Lenders and Lending Partners: Third-party lenders in our network for the purpose of evaluating your application, matching you with loan offers, determining eligibility, processing your loan, and servicing your account
  • Consumer Reporting Agencies: For the purpose of obtaining credit reports and, where applicable, furnishing information about your account (e.g., payment history) to credit bureaus
  • Service Providers: Third parties who perform services on our behalf, such as identity verification, fraud prevention, analytics, and processing, subject to confidentiality obligations
  • Regulatory and Legal Authorities: When required by law, court order, or government request

You understand that lenders in our network have their own privacy policies and may use your information in accordance with their own practices, subject to applicable law.

4. Permissible Purpose Under the Fair Credit Reporting Act

You acknowledge that the FCRA permits consumer reporting agencies to furnish consumer reports to persons who have a legitimate business need for the information. By providing this Authorization, you confirm that:

  • You are applying for credit, insurance, or other permitted purposes
  • We and our lending partners have a permissible purpose under Section 604 of the FCRA to obtain your credit report
  • You are providing this Authorization voluntarily and with full understanding of its scope

5. How Your Credit Information Is Used

Your credit information may be used by us and our lending partners to:

  • Evaluate your eligibility for loan products
  • Determine loan amounts, interest rates, and terms for which you may qualify
  • Verify your identity and prevent fraud
  • Match you with loan offers from our network of lenders
  • Comply with legal and regulatory requirements
  • Service your account if you obtain a loan through our Service
  • Conduct quality assurance and improve our Service

We do not make credit decisions. All loan approval decisions, loan terms, and funding are determined solely by the third-party lenders. We are a loan matching service and do not guarantee that you will receive a loan offer or that any offer will meet your needs.

6. Impact on Your Credit Score

You understand that:

  • Credit checks, particularly hard inquiries, may affect your credit score. The impact varies depending on your credit history and the scoring model used
  • Submitting multiple applications through our Service may result in multiple inquiries from different lenders
  • Some lenders may use alternative data or credit scoring models that do not rely solely on traditional credit reports
  • If you accept a loan offer, the lender may report your payment history to consumer reporting agencies, which may affect your credit score positively or negatively

We encourage you to review your credit report regularly and understand your credit standing before applying for credit.

7. Your Rights Under the Fair Credit Reporting Act

Under the FCRA, you have the right to:

  • Know what is in your file: You may request and obtain a copy of your credit report from consumer reporting agencies. You may be entitled to one free credit report per year from each of the three nationwide credit bureaus at www.annualcreditreport.com
  • Dispute inaccurate information: If you believe information in your credit report is inaccurate or incomplete, you have the right to dispute it with the consumer reporting agency and the information furnisher
  • Receive notice of adverse action: If a lender takes adverse action (e.g., denies your application) based in whole or in part on information in a credit report, the lender must provide you with an adverse action notice. The notice will include the name, address, and phone number of the consumer reporting agency that supplied the information
  • Limit prescreened offers: You may opt out of prescreened credit offers by calling 1-888-5-OPT-OUT (1-888-567-8688) or visiting www.optoutprescreen.com

8. Duration and Scope of Authorization

This Authorization applies:

  • From the date you submit your application or otherwise indicate your consent
  • For the duration of the loan application process and any resulting loan relationship
  • To all applications you submit through our Service, unless you withdraw consent as described below

You understand that lenders may retain your information and credit report data in accordance with their own practices and applicable law, even after you withdraw consent for future use.

9. Withdrawal of Authorization

You may withdraw your authorization for future credit checks and information sharing at any time by contacting us at [email protected] or through our Contact page. Withdrawal will:

  • Prevent us from obtaining new credit reports or sharing your information with new lenders for future applications
  • Not affect credit checks or information sharing that occurred before your withdrawal
  • Not affect any existing loan relationship you have with a lender
  • May limit or prevent your ability to receive loan offers through our Service

We will process your withdrawal request within a reasonable time. Please note that if you have already been matched with a lender or have an active application, that lender may have already obtained your credit report and may retain it in accordance with their policies.

10. Accuracy of Information

You represent and warrant that all information you provide in your application, including but not limited to your name, date of birth, Social Security number, address, employment, and income, is accurate, current, and complete. You understand that providing false or misleading information may result in application denial, account termination, and referral to law enforcement. You authorize us and our lending partners to verify any information you provide through third-party sources, including consumer reporting agencies.

11. State-Specific Disclosures

Certain states require additional disclosures or impose specific requirements regarding credit checks and consumer reports. Where applicable, we will provide state-specific disclosures as part of the application process or in separate communications. By way of example:

  • California: California residents may have additional rights under the California Consumer Credit Reporting Agencies Act (CCRAA) and the California Consumer Privacy Act (CCPA). You may request information about the consumer reporting agencies we use.
  • New York: New York residents may have additional rights under the New York Fair Credit Reporting Act.
  • Other States: Your state may have laws that provide additional protections or require additional disclosures. We comply with applicable state and federal law.

12. Consent to Contact

By providing your telephone number(s) and email address, you consent to receive calls (including autodialed, prerecorded, and/or artificial voice calls) and text messages from us, our affiliates, and our lending partners at the numbers you provide, including wireless numbers, regarding your application, account, and loan offers. Message and data rates may apply. You may opt out of marketing calls and texts at any time. Consent to contact is not required to obtain our services. 13. Electronic Signature and Consent

By submitting an application, checking a box indicating your agreement, clicking "I Agree," or otherwise using our Service, you acknowledge that you have read and understand this Credit Authorization and agree to its terms. You consent to conduct this transaction electronically in compliance with the Electronic Signatures in Global and National Commerce Act (ESIGN) and applicable state laws. Your electronic signature has the same legal effect as a handwritten signature.

14. Relationship to Other Documents

This Credit Authorization supplements and is incorporated by reference into our Terms of Use, Privacy Policy, and E-Consent. In the event of any conflict between this Authorization and those documents, the provisions of this Authorization shall apply with respect to credit checks and consumer report information.

15. Changes to This Authorization

We may update this Credit Authorization from time to time to reflect changes in our practices, applicable law, or the Service. We will notify you of material changes by posting the updated Authorization on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Authorization. If you do not agree to the changes, you must withdraw your authorization and discontinue use of the Service.
